for tourist attraction operators

 

A tourist attraction is a natural or man-made attraction or geographical area utilised and operated for tourism purposes that provides visitors with experience, leisure or travel services, a range of offers or entertainment functions. The registration obligation applies to operators already providing tourist attraction activities on 1 November 2021, or commencing such activities thereafter.

The visitor (guest) is a natural person who utilises the service offered by the tourist attraction obliged to report data, with a ticket, pass or season ticket, regardless of the person who pays for the service.

A tourist attraction subject to data reporting is a tourist attraction, the operator of which provides use of the services of the attraction on a continuous, periodic or ad hoc basis, with tickets required for entry, by means of ticket sales or ticket issue.

The following tourist attractions obliged to register and report data are required to register by 1 November 2021 and to start reporting data from 1 July 2023.  Accordingly, service providers must complete their registration by the start of data reporting and they must ensure that they have ticket sales software suitable for fulfilling their data reporting obligations.

 

Tourist attractions subject to registration and data reporting

  1. public baths, which
    1. qualify as public baths under Section 1 (2) of Government Decree 121/1996 of 24 July on the establishment and operation of public baths, or
    2. provide at least one of the services listed below:
      • TEÁOR ‘08 29 Other entertainment and leisure activities n.e.c. (of which: ÖVTJ 932903 Lido services), or
      • TEÁOR ‘08 04 Physical well-being activities (of which: ÖVTJ 960403 Baths services, the activities of Turkish baths, saunas, steam rooms and spas,
  2. natural bathing locations, which
    1. qualify as natural bathing locations under Section 2 (b) of Government Decree 78/2008 of 3 April on the quality requirements for natural bathing waters and the designation and operation of natural bathing locations,
    2. TEÁOR ‘08 29 Other entertainment and leisure activities n.e.c. (of which: ÖVTJ 932903 Lido services;
  3. museum-type institutions, castles and mansions, which
    1. have an operating licence under Section 39 of Act CXL of 1997 on Museum Institutions, Public Library Services and Public Education, or
    2. offer TEÁOR ‘08 02 Domestic museum services;
  4. the following means of transport associated with the tourist transport infrastructure:
    1. Balatoni Hajózási Zrt. routes, or
    2. MAHART – PassNave Személyhajózási Kft. routes, or
    3. TEÁOR ‘08 39 Other land passenger transport n.e.c., specifically the “hop-on hop-off” type scheduled city sightseeing bus service,
  5. adventure parks, which
    1. offer TEÁOR ‘08 93.29 Other entertainment and leisure activities n.e.c., or
    2. TEÁOR ‘08 11 Sports facility operations, or
    3. TEÁOR ‘08 21 – Amusement park and theme park activities;
  6. zoos, which
    1. qualify as zoos under Section 3 point 3 of Act XXVIII of 1998 on Animal Protection and Welfare, or
    2. offer TEÁOR ‘08 04 Botanical and zoological garden services and nature reserve services;
  7. amusement park, which
    1. offers TEÁOR ‘08 21 – Amusement park and theme park services;
  8. protected nature area exhibition, which
    1. qualifies as a protected nature area exhibition site under Section 28 of Act LIII of 1996 on Nature Protection, or
    2. offers TEÁOR ‘08 04 Botanical and zoological garden services and nature reserve services;
  9. events involving music or dancing under Government Decree 23/2011 of 8 March on increasing the safety of events involving music or dancing.

ATTRACTION registration

In line with operative legislation, the tourist attraction operator (its owner, lessee, operator or manager) must register in the NTDSC.

After registration, the tourist attraction operator will receive a unique registration number created for keeping records on the registered tourist attraction. This is the NTDSC registration number.

Data to be reported

Data must be submitted from 1 July 2022.

After registering in the NTDSC, the tourist attraction operator will fulfil the data reporting obligation electronically, using ticket sales software.

During data reporting starting no sooner than 1 July 2022, the ticket sales software shall automatically submit the traffic data pertaining to the target day and subject to daily reporting that do not include any personal data, at least once a day and within 24 hours of the target day. When the given day is closed, the traffic data for the tourist attraction on that day are submitted to the NTDSC.

If data submission is unsuccessful due to an operation failure or outage, the data must be submitted on the day after the operation failure or outage is eliminated.

Softwares

In line with operative legislation, the ticket sales software is a computer program that is suitable for on-site or online ticket sales and ticket validation, and forwarding data to the NTDSC, which must be used by the tourist attraction operator and which meets the technical requirements specified in the Government Decree.

Only ticket sales software that is able to communicate with the NTDSC and that has a certificate issued by the HTA may be used for data reporting.

The certification verifies that the system met the requirements in force on the date of issuce.

Free software

The HTA will provide tourist attraction operators with unrestricted access to free ticket sales software suitable for the quick and easy performance of all administrative tasks and the fulfilment of day-to-day NTDSC data reporting obligations.
