catering establishment operators

 

Under the terms of operative legislation, all catering establishment operators (owners or lessees) in Hungary must register the catering establishment in the NTDSC.

The catering establishments with data reporting obligation are required to register by 1 November 2021 and to start reporting data from 1 July 2023.  Accordingly, service providers must complete their registration by the start of data reporting (1 July 2022) and ensure that they have catering software suitable for fulfilling their data reporting obligations.

 Catering establishments may only be registered according to the types defined in Government Decree 210/2009 of 29 September.  The catering establishment types defined in Annex 4 to Government Decree 210/2009 of 29 September on the conditions for pursuing certain commercial activities are those that pursue the catering activities in accordance with Section 2 point 30 of Act CLXIV of 2005 on Commerce.

Under the terms of Government Decree 210/2009 of 29 September, the notary with regional jurisdiction must be notified of the catering establishment type by 31 March 2021. If the service provider has not yet done this, we recommend they do so as soon as possible.

The types of catering establishments obliged to register in the NTDSC, under the terms of Government Decree 210/2009 of 29 September on the performance of commercial activities:

  • restaurants, TEÁOR’08: 5610 - restaurants and mobile catering services
  • buffets, TEÁOR’08: 5610 - restaurants and mobile catering services
  • confectionaries, TEÁOR’08: 5610 - restaurants and mobile catering services
  • cafés, catering establishments specialising in non-alcoholic beverages, TEÁOR’08: 5630 – drinks services;
  • pubs and bars, TEÁOR’08: 5630 – drinks services;
  • music and dance clubs, TEÁOR’08: 5630 – drinks services;
  • workplace/public catering establishments, TEÁOR’08: 5629 - other catering;
  • fast food restaurants, TEÁOR’08: 5610 - restaurants and mobile catering services
  • catering services for events, TEÁOR’08: 5621 – catering for events;
  • ad hoc restaurants, TEÁOR’08: 5610 - restaurants and mobile catering services
  • mobile catering services, TEÁOR’08: 5610 - restaurants and mobile catering services.

A catering establishment required to report data to the NTDSC is a business required to fulfil its obligation to issue receipts using a cash register and which must use an online cask register under the terms of Decree of the Ministry for the National Economy 48/2013 of 15 November on the technical requirements of cash registers, on the distribution, use and servicing of cash registers used to issue receipts, and on reporting the data recorded with the use of cash registers to the tax authority. According to the Decree, the use of an online cash register is required in the activities specified in TEÁOR numbers 56.1 and 56.3, apart from mobile services.

Based on the above, the types of catering establishments obliged to report data to the NTDSC:

  • restaurants, TEÁOR’08: 5610 - restaurants and mobile catering services
  • buffets, TEÁOR’08: 5610 - restaurants and mobile catering services
  • confectionaries, TEÁOR’08: 5610 - restaurants and mobile catering services
  • cafés, catering establishments specialising in non-alcoholic beverages, TEÁOR’08: 5630 – drinks services;
  • pubs and bars, TEÁOR’08: 5630 – drinks services;
  • music and dance clubs, TEÁOR’08: 5630 – drinks services;
  • fast food restaurants, TEÁOR’08: 5610 - restaurants and mobile catering services
  • ad hoc restaurants, TEÁOR’08: 5610 - restaurants and mobile catering services.

Establishments classified as workplace/public catering, those catering for events, or mobile catering providers are not required to report data to the NTDSC.

The depersonalised statistical data submitted to the NTDSC enable the performance of a given town, tourism region, or even the entire tourist sector, to be clarified and quantified, even with sectoral breakdown. The NTDSC collects statistical data for tourism purposes only. The system is unable to accept personal data. The service provider always provides the statistical data to the NTDSC free of charge.

CATERING ESTABLISHMENT registration

 

Under the terms of operative legislation, the operator of a catering establishment (owner or lessee) must register in the NTDSC.

 After registration, the operator of the catering establishment will receive a unique registration number for the purpose of keeping records on the registered catering establishment. This is known as the NTDSC registration number.

Data to be reported

Data must be submitted starting 1 July 2022.

 

Following registration in the NTDSC, the catering establishment operator must ensure that the data for each catering establishment subject to data submission are forwarded electronically using catering software suitable for submitting data to the NTDSC.

After registration, the catering software shall automatically submit the traffic data pertaining to the target day and subject to daily reporting that do not include any personal data, at least once a day and within 24 hours of the target day. When the given day is closed, the traffic data for the catering establishment on that day are submitted to the NTDSC.

Detailed information on the range of data to be submitted will be published shortly, of which registered service providers will be notified by e-mail. Please register as soon as possible and check our website from time to time.

If data submission is unsuccessful due to an operation failure or outage, the data must be submitted on the day after the operation failure or outage is eliminated.

If a catering establishment operator fails to submit daily data despite being called to do so repeatedly by the NTDSC operator, the NTDSC operator will initiate an official inspection of the catering establishment operator by the notary in charge of supervising the catering establishment operator.

Software

Under the terms of Government Decree 210/2009 of 29 September on the conditions for the performance of certain commercial activities, catering software is a computer program to be used by the operator of a catering establishment required to comply with data reporting obligations, which is suitable for forwarding the required data to the NTDSC. Only  catering software that is able to communicate with the NTDSC and that has a certificate issued by the HTA may be used for data reporting.

The certification verifies that the system met the requirements in force on the date of issue.

Free software

The HTA will provide operators of catering establishments with unrestricted access to free catering software suitable for the quick and easy performance of all administrative tasks and fulfilment of the day-to-day NTDSC data reporting obligation starting. Detailed information on the free software will soon be published, of which registered service providers will be notified by e-mail.  Please register as soon as possible and keep an eye on our website.

Monitoring

 

Proceeding in their competence as commercial authority, the notary with regional jurisdiction for the registered address of the catering establishment shall monitor the NTDSC registration of catering businesses, as well as regular and accurate data reporting to the NTDSC.

Under the terms of Government Decree 210/2009 of 29 September on the performance of commercial activities, the NTDSC data reporting activities of a registered catering establishment will be checked at least once a year as part of an official inspection. The notary shall notify the NTDSC operator of any catering establishments that should be using catering software but do not have any, or which are found by the official inspection to have not registered in the NTDSC, or which have not complied with the data reporting obligation prescribed by Government Decree 235/2019 of 15 October implementing the Act on state responsibilities regarding the development of tourism regions, or have done so incorrectly.
